Another Victory For Conservatives And Defeat For Biden! Judge Rules In Favor Of Sanity

As the Culture War heats up to white hot levels, it is courtrooms rather than legislative chambers where the ultimate victors are being declared. The Supreme Court has been the setting for a series of recent conservative triumphs, most notable of which were the Dobbs V. Jackson case which overturned Roe V. Wade, as well as the defeat of a tyrannical state gun law prohibiting the carrying of concealed weapons in New York State Rifle & Pistol Association v. Bruen.

But decisions in lower courts are critical as well, and decisions there often set the tone and lay the parameters for extended, more long-term battles. Such is the case with a recent ruling by a federal judge in Tennessee regarding the transgender debate and the efforts of the Biden Administration’s Education Department which is trying to force its far-left transgender ideology upon state and local governments.

According to Bloomberg News:

“A judge in Tennessee temporarily blocked the Biden administration’s rules ensuring transgender people at schools and workplaces have access to bathrooms, locker rooms and sports teams, the latest setback for LGBTQ Americans amid a backlash from Republican-led states.

Mandates issued last year following an executive order by President Joe Biden clash with state laws restricting such access for transgender students and employees, US District Judge Charles Atchley ruled Friday evening. The decision blocks the rules nationwide until the case is resolved.”

The earlier injunction had been applied following a suit brought against the Administration by twenty red states and was widely viewed as a significant defeat for the president’s increasingly radical LBGTQ agenda. The injunction will remain in place until the case’s final resolution which could take months.

What’s particularly notable about this case is the rhetoric that is seeping into the reporting on the topic, and we see it in the article from Bloomberg and other reporting coming from the Democrats’ communications department, otherwise known as the activist mainstream media.

The point that transgender folks are being denied “access” to bathrooms and sports teams is, of course, absurd. Transgender folks have the same access as everyone else in these states, they simply must play for the teams that align with their actual gender and must use the corresponding bathrooms and locker rooms.

The red state laws targeted by the Biden Administration state that someone doesn’t just get to choose which gender they are. Gender is specific and biologically determined, not merely some abstract concept. In other words, the red states that brought suit against the Administration are in favor of common sense.

Meanwhile, it’s becoming increasingly apparent that the position of the Administration and several blue states is utterly unsustainable. There’s no logic or science being applied, only emotion and virtue-signaling, and the policies that emerge are absurd.

In New Jersey, for instance, a transgender inmate at their maximum security correctional facility for women impregnated two other inmates and the state has now moved the inmate to a men’s prison. And it’s worth noting that the state’s policy on housing transgender folks changed just last year; perhaps they’ll consider reverting to their previous approach.

What the ruling by Judge Atchley and the debate surrounding this latest case illustrates is the struggle of misidentified ‘compassion’ versus true fairness and sanity. In the left’s effort to legislate compassion by allowing biological men to compete against women in organized sports and arbitrarily allowing them to use female bathrooms, they are negatively impacting women. The party of feminism has abandoned the very idea of gender, a concept that is fundamentally in conflict with the push for women’s rights. And their argument is crumbling before their eyes, both in statehouses and in the courts.
